These Terms of Service ("Terms") are an agreement between you and Ruben Pretorius ("we", "us") governing your use of the DocuSense mobile application ("the app"). By downloading or using the app you agree to these Terms. If you do not agree, do not use the app.
1. What DocuSense does
DocuSense lets you photograph or upload documents and uses artificial intelligence (Google's Gemini models) to produce plain-language summaries, highlight potential concerns, extract key dates and figures, define terms, and answer follow-up questions. Documents and generated explanations are stored locally on your device; processing happens through third-party services described in our Privacy Policy.
2. ⚠️ Not professional advice — read this section carefully
DocuSense provides general information only. Its output is not legal, medical, financial, tax, or other professional advice, and no attorney–client, doctor–patient, or advisor–client relationship is created by using the app.
AI output can be wrong. Explanations may be incomplete, inaccurate, outdated, or miss important terms and risks. A section reported as "no major concerns" may still contain provisions that harm your interests.
Always consult a qualified professional (lawyer, doctor, financial adviser) before signing anything or making decisions based on a document. You agree that you will not rely on the app as a substitute for professional review.
You use the app's output at your own risk.
3. Eligibility and accounts
You must be at least 13 years old (or the higher minimum age of digital consent in your country) to use the app, and at least 18 to purchase a subscription.
The app creates an anonymous account automatically; you may optionally sign in with Google. You are responsible for activity occurring under your account and for keeping your device secure.
4. Your documents and content
You keep ownership of the documents you capture or upload and the questions you ask.
You grant us and our service providers a limited licence to process that content solely to operate the app's features (e.g. sending a document image to Google's Gemini API to generate your explanation), as described in the Privacy Policy. We do not sell your content.
Only submit documents you are allowed to use. You warrant that your use of any document in the app does not violate another person's rights (including privacy, confidentiality, and copyright) or any law. Do not upload documents containing other people's personal data without their permission, and do not upload content that is unlawful.
You are responsible for backing up anything important. Explanations and history are stored locally and are deleted if you uninstall the app.
5. Acceptable use
You agree not to:
use the app for any unlawful purpose, or to facilitate fraud or harm;
attempt to bypass usage limits, subscription gating, or security measures (including circumventing the free-tier quota or forging entitlements);
reverse engineer, decompile, or resell the app or its AI output as a competing service;
probe, overload, or disrupt the app's infrastructure or third-party services;
use the app to generate or process content that is illegal in your jurisdiction.
We may suspend or terminate access for breach of these Terms.
6. Subscriptions and billing
DocuSense offers a free tier (limited number of document explanations per month and limited features) and a Premium subscription (monthly or annual) that unlocks unlimited explanations, chat, full glossary, unlimited history, and export.
Billing is handled by Google Play. Prices are shown in the app before you buy. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before renewal.
Cancel anytime in Google Play → Subscriptions. Cancelling stops future renewals; you keep Premium until the end of the period already paid for.
Refunds are governed by Google Play's refund policies and applicable consumer law. Statutory rights (e.g. under the South African Consumer Protection Act, EU consumer law) are not affected by these Terms.
Prices may change; changes apply from the next billing period and Google will notify you as required.
Subscription status is validated through our subscription provider (RevenueCat); entitlements obtained fraudulently may be revoked.
7. Third-party services
The app depends on third-party services — including Google Play, Google Firebase, Google's Gemini API, and RevenueCat — each governed by its own terms. We are not responsible for outages or changes in those services, and features may be unavailable when they are.
8. Intellectual property
The app, its design, branding, and code are owned by us or our licensors and are protected by law. These Terms give you a personal, non-exclusive, non-transferable, revocable licence to use the app on your Android device. You may use the explanations the app generates for your own personal, non-commercial purposes.
9. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE OR COMPLETE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP — INCLUDING DECISIONS MADE, OR CONTRACTS SIGNED, IN RELIANCE ON AI-GENERATED EXPLANATIONS.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND (B) ZAR 1,000 (approximately USD 50).
NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED BY LAW (INCLUDING UNDER APPLICABLE CONSUMER PROTECTION LEGISLATION).
11. Indemnity
You will indemnify us against claims arising from your breach of these Terms, including claims that a document you submitted infringed someone else's rights.
12. Termination
You may stop using the app at any time; uninstalling deletes local data. We may suspend or terminate access (with notice where practicable) for breach of these Terms or where required by law. Sections 2, 4, and 8–11 survive termination.
13. Changes to the app or these Terms
We may modify or discontinue features, and may update these Terms. For material changes we will provide notice in the app or by other reasonable means; continuing to use the app after changes take effect means you accept the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of South Africa, without affecting mandatory consumer protections in your country of residence. Disputes will be resolved in the courts of South Africa, unless applicable law gives you the right to a different forum.
